Definition of Leak-Proof Guarantee Program for Molded Manifold Connections of Silicone

VALIDATION OF THE LEAK FREE GUARANTEE

The validation process used to support the leak free guarantee was conducted utilizing and verifying the following data:

  • A review of customer complaint records
  • Direct conversations with current customers of the molded tubing connections in real usage conditions
  • Test results of the Master Manifold Qualification

The Quality department performed a detailed review of the customer complaint database records from the initial release of this product line in 2006 through the present and found zero reports of leakage due to the molded tubing connection. This review indicates that the molded components in use performed to the customers’ expectations.

The AdvantaPure sales force utilized its established relationships with the customers of molded products to validate the leak free statement. This was done both by phone conversations and direct contact during onsite visits. The customers confirmed that there were no recorded failures, and they did not experience leaking with any molded tubing connections produced by NewAge Industries / AdvantaPure.

During the documented initial qualification and subsequent semi-annual testing of our Master Manifold, all test units performed to specified test parameters. Various molded connections were tested under pressure for a specific time with no leakage.

To summarize, this in-depth data review of hundreds of thousands of delivered molded assemblies has allowed NewAge Industries / AdvantaPure to state that our molded connections are verified to be found leak-free in testing and real customer usage situations. It also allows NewAge Industries / AdvantaPure to provide a limited guarantee against leakage.

LIMITED WARRANTY

NewAge Industries Inc. / AdvantaPure (hereinafter “NIAI”) warrants to the end user that the silicone manifold containing leak-proof molded connections is free from defects in material and workmanship in accordance with the product’s defined shelf life warranty, which is available upon request. It only covers molded silicone connections of the WYE, TEE, CROSS, and REDUCER styles and excludes molded Tri-Clamp® and Mini Tri-Clamp styles and any other style connection that requires physical adaption to another device or where human error or another manufacturer’s craftsmanship may be involved. Should the molded connections leak within this warranty period, the manifold is fully covered as defined in the WARRANTY policy found within our Corporate Terms & Conditions of Sale Statement and in accordance with our NIAI Return Product Policy stated within. In no event shall NIAI’s liability for any damages or loss to the buyer, end user or to any third party exceed the purchase price paid to NIAI. NIAI specifically reserves the right to discontinue or modify any of its molded silicone connections of the Wye, Tee, Cross, and Reducer styles. If NIAI replaces any product under this warranty, it may, at its sole discretion, substitute products that are designated by NIAI to be of comparable quality in the event the product initially installed has been modified or is no longer available.

NIAI reserves the right to refund the customer in US dollars or as a credit to their account for the cost of the product defined as warranted and specifically excludes the costs associated with other components that may be assembled to the original manifold.

This warranty does not apply to any manifold that has been subjected to misuse, installation error, improper storage, or has been tampered with in any way. It is the user’s responsibility to ensure the proper storage, suitability and safety of NIAI products for all intended uses. The user is responsible for any required testing. All advice is given and accepted at the user’s risk. The user assumes all other risk, including that of injury, loss or damage, direct or indirect, resulting from the use, misuse, or inability to use this product. NIAI only warrants the molded manifold itself and in no event shall NIAI be liable or responsible for any lost fluid or product within the manifold, damage to equipment, lost time, and/or labor involved with the installation or use of the product, removal of defective product, or installation of replacement product.

OTHER THAN THE WARRANTY SET FORTH ABOVE, THERE ARE NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, AND IN NO EVENT SHALL NIAI BE LIABLE UNDER THE IMPLIED WARRANTIES OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE OR COMPATIBILITY. IN NO EVENT SHALL NIAI BE LIABLE FOR SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND RESULTING FROM THE BREACH OF ANY WARRANTY SET FORTH HEREIN. NO SALES REPRESENTATIVE OF NIAI OR ANY DISTRIBUTOR OR DEALER IS AUTHORIZED TO MAKE ANY CHANGE OR MODIFICATION TO THIS WARRANTY.

This limited warranty statement gives the customer specific legal rights. The customer may also have other rights which vary from state to state, country to country, or jurisdiction to jurisdiction. Since some states, countries or jurisdictions do not permit the exclusion of implied warranties or limitation of liability for consequential damages, in such states, countries or jurisdictions; liability is limited to the fullest extent permitted by law. Any litigation resulting from this program must be held within the limits and laws of the Commonwealth of Pennsylvania and the United States of America.
